GARUT || Telah terjadi penyerangan yang dilakukan oleh beberapa oknum warga yang diduga berasal masyarakat Papandayan Desa Pada Mukti Kecamatan Sukaresmi terhadap keluarga tokoh DKM berinisial H.R Kp. Pasirkawao Desa Sukaresmi Kecamatan Sukaresmi pada malam minggu 30 november sekitar pukul 19.30 wib adapun korban yang dianiyaya yang berinisial WH (25 thn), AD (18th) dan AN (22 thn).

hasil konfirmasi terhadap keluarga Korban pengeroyokan penganiayaan AD yg berniat memisah WD yg sedang di pukuli oleh para pelaku tersebut mengalami luka luar dalam karna selain dipukuli AD yg telah terkapar di selokan kecil pinggir rumah di hantam oleh pot bunga yg terpajang diluar depan rumah TKP dan disaksikan oleh ibunya yg menjerit jerit melihat anaknya dikroyok setelah bubar para pelaku situasi mereda keluarga korban


Malam itu juga dilarikan ke Puskesman Bayongbong untuk di tangani pengobatan dan cek Visium dan kejadian tersebut telah dilaporkan oleh ibu korban juga beberapa tokoh Kp.Pasirkawao ke Polsek Cisurupan. bahkan telah di BAP oleh pihak penyidik Polsek cisurupan


Keluarga korban yg aktip di jurnalis juga lembaga hukum menanbahkan bahwa Walaupun kejadian ini Diduga berasal dari kesalah pahaman setelah pertandingan futsal di Cikajang tapi yg terjadi sangatlah tidak beretika melanggar hukum pidana yg murni dalam pengeroyokan diatur dalam Pasal dalam KUHP yang mengatur tentang pengeroyokan diatur dalam Pasal 170, sedangkan pasal yang mengatur tentang pemukulan atau penganiayaan adalah Pasal 351 sampai dengan 356 KUHP:
Pengeroyokan
Pasal 170 KUHP mengatur tentang pengeroyokan, yaitu tindakan melakukan kekerasan secara bersama-sama dan terang-terangan terhadap orang atau barang. Ancaman hukumannya adalah penjara paling lama 5 tahun 6 bulan.
Pemukulan atau penganiayaan
Pasal 351 sampai dengan 356 KUHP mengatur tentang pemukulan atau penganiayaan. Ancaman hukumannya mulai dari 2 tahun 8 bulan sampai dengan 8 tahun plus 1/3 jika perbuatan itu termasuk penganiayaan berat terencana terhadap orang.
Pembelaan diri yang terpaksa untuk diri sendiri atau orang lain tidak dipidana.
penyerangan juga pengrusakan diatur Pasal dalam KUHP yang mengatur tentang masuk rumah orang lain tanpa izin adalah Pasal 167 ayat 1, 2, 3, atau 4. Pasal ini berlaku jika tindakan tersebut menimbulkan rasa tidak nyaman atau ketakutan pada penghuni rumah.
Selain itu, pelaku yang memaksa masuk ke rumah orang lain dengan melawan hukum atau berada di situ dengan melawan hukum juga dapat dijerat dengan pasal ini. Pelaku yang melanggar pasal ini diancam dengan pidana penjara paling lama 5-9 bulan.
Menurut keluarga korban peristiwa ini berharap penegak hukum dalam hal ini kepolisian Polsek cisurupan untuk memproses sesuai pasal pasal yg dilanggar oleh para pelaku tersebut
Segera berikan efek jera pada para pelaku jangan sampai kejadian ini berlarut larut seakan kepolisian tidak tegas dalam menangani kejadianini kita akan kawal sampai tuntas tanpa mediasi karna tidak maunya melahirkan calon calon preman yg diduga mempunyai beking dibelakang pelaku yg hanya memperkeruh di suasana kejadian dan saya percaya pihak aph yg ada di kabupaten Garut selalu menyisir dan memberantas para pelaku yg slalu meresahkan warga masyarakat.
